CCPA Privacy Notice
Additional privacy rights and disclosures for California residents, under the California Consumer Privacy Act.
Effective and last updated: September 16, 2026
This Privacy Notice for California Residents supplements our Privacy Policy and applies solely to visitors, users, and others who reside in the State of California (“consumers” or “you”). We adopt this notice to comply with the California Consumer Privacy Act of 2018, as amended (“CCPA”); terms defined in the CCPA have the same meaning here. Vertex Capital is a Capital Express Holdings LLC company — Capital Express Holdings LLC’s own CCPA notice, which this one is aligned with, is published at capitalexpressllc.com/ccpa-privacy-notice.
This notice does not apply to employment-related personal information collected from California-based employers, job applicants, contractors, or similar individuals. Where noted, the CCPA temporarily exempts personal information reflecting a written or verbal business-to-business communication (“B2B personal information”) from some of its requirements.

1.Information we collect
The Site collects information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer, household, or device (“personal information”). Personal information does not include publicly available government-record information, deidentified or aggregated information, or information excluded from the CCPA’s scope — such as health information covered by HIPAA and the California Confidentiality of Medical Information Act, or information covered by sector-specific laws like the Fair Credit Reporting Act, the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act, and the Driver’s Privacy Protection Act.
In the preceding twelve (12) months, the Site has collected these categories of personal information:
| Category | Examples | Collected |
|---|---|---|
| A. Identifiers | Name, alias, postal address, unique personal identifier, online identifier, IP address, email address, account name, or similar identifiers. | Yes |
| B. California Customer Records categories (Cal. Civ. Code § 1798.80(e)) | Name, address, telephone number, and — only where you have voluntarily provided it in connection with a funding inquiry — financial information such as bank account or revenue figures. We do not request Social Security numbers, driver’s license numbers, or similar government ID numbers through the Site’s forms. | Partial |
| C. Protected classification characteristics under California or federal law | Age, race, national origin, religion, sex, sexual orientation, veteran or military status, and similar characteristics. | No |
| D. Commercial information | Records of products or services considered or requested (for example, a funding inquiry), and related history. | Yes |
| E. Biometric information | Fingerprints, faceprints, voiceprints, or similar identifiers. | No |
| F. Internet or other similar network activity | Browsing history, search history, and interaction with the Site. | Yes |
| G. Geolocation data | General location derived from IP address. | Yes |
| H. Sensory data | Audio, electronic, visual, or similar information. | No |
| I. Professional or employment-related information | Business role, title, and industry, as submitted on the broker/ISO or merchant forms. | Yes |
| J. Non-public education information | Education records under FERPA. | No |
| K. Inferences drawn from other personal information | A profile reflecting preferences or characteristics inferred from the information above. | Yes |
We obtain these categories from the following sources: directly from you (forms you complete or requests you make on the Site); indirectly from you (observing your actions on the Site, or usage details such as IP address or browser type captured automatically); and from third parties that interact with us in connection with services provided to users — for example, a broker or ISO that presents a funding deal to us on your behalf.
2.Use of personal information
We may use or disclose personal information to: fulfill the reason you provided it (for example, responding to an inquiry or evaluating a funding request); provide, support, and improve the Site; process your requests and help prevent fraud; support and respond to your inquiries; personalize your experience on the Site and, with consent where required by law, deliver relevant offers; maintain the safety and security of the Site and our systems; conduct testing, research, and product development; share information with vendors as required to provide our services; respond to law enforcement and legal requirements; and evaluate or conduct a merger, financing, reorganization, or sale of assets. We will not collect additional categories of personal information or use what we’ve collected for materially different, unrelated, or incompatible purposes without providing notice.
3.Sharing personal information
We may disclose personal information to a third party for a business purpose under a contract that requires the recipient to keep it confidential and use it only to perform that contract. We share personal information with these categories of third parties: service providers; funding and underwriting partners; a broker or ISO who submitted your business; and data-processing vendors necessary to operate the Site.
4.Disclosures for a business purpose
In the preceding twelve (12) months, we may have disclosed the following categories of personal information for a business purpose: Identifiers (A); partial California Customer Records information (B); Commercial information (D); Internet/network activity (F); Geolocation data (G); Professional/employment information (I); and Inferences (K).
5.Sales of personal information
We do not sell your personal information and have not sold personal information in the preceding twelve (12) months.
6.Your rights and choices
The CCPA provides California consumers with specific rights regarding their personal information. This section describes those rights and how to exercise them.
7.Access & data portability rights
You have the right to request that we disclose what personal information we’ve collected about you, its sources, our purpose for collecting it, the categories of third parties we’ve shared it with, and the specific pieces of personal information we hold (a data portability request), covering the preceding 12 months.
8.Deletion request rights
You have the right to request that we delete personal information we’ve collected from you, subject to certain exceptions — for example, where retaining it is necessary to complete a transaction you requested, detect security incidents or fraud, comply with a legal obligation, or make other internal and lawful uses compatible with the context in which you provided it.
9.Exercising your rights
To submit a verifiable consumer request for access, portability, or deletion, email us at support@capitalexpressllc.com. Only you, or someone legally authorized to act on your behalf, may submit a request related to your information, and you may make an access or portability request up to twice in a 12-month period. Your request should include enough information for us to reasonably verify your identity (such as your name, phone number, email, and address) and describe your request with enough detail for us to evaluate and respond to it. We cannot respond to, or provide personal information in response to, a request we cannot verify.
10.Response timing and format
We will respond to a verified request as required by law, generally in writing, either to your account (if you have one) or by mail or electronically at your option. Disclosures cover only the 12-month period preceding the request. For data portability requests, we’ll provide your information in a format that is readily usable and allows you to transmit it to another entity without hindrance. We don’t charge a fee to process a request unless it is excessive, repetitive, or manifestly unfounded, in which case we’ll explain why before proceeding.
11.Sale opt-out & opt-in rights
Because we do not sell personal information, we do not maintain a “Do Not Sell or Share My Personal Information” opt-out process for that category of CCPA right.
12.Non-discrimination
We will not discriminate against you for exercising any CCPA right. Unless permitted by the CCPA, we will not deny you goods or services, charge different prices or rates, provide a different level or quality of goods or services, or suggest that any of those things might happen because you exercised your rights.
13.Other California privacy rights
California’s “Shine the Light” law (Civil Code § 1798.83) lets California residents request certain information about our disclosure of personal information to third parties for their own direct marketing purposes. To make such a request, email support@capitalexpressllc.com or write to 405 Lexington Ave, Suite 900, New York, NY 10174.
14.Changes to this notice
We may amend this notice at our discretion. When we do, we’ll post the updated notice on the Site and update the effective date above. Your continued use of the Site after changes are posted constitutes your acceptance of them.
